1. About Our Service

CarBuying NZ is a lead generation and comparison service that connects potential car buyers with vehicle dealers. We do not sell vehicles, arrange financing, or act as a dealer or broker.

2. What We Do

When you submit a quote request through our website:

We collect your vehicle requirements and contact details
We share this information with dealers in our network
Dealers provide quotes to us
We compile and send you the competing quotes
You choose which dealer (if any) you wish to proceed with
You deal directly with your chosen dealer for all purchase arrangements

3. No Charge to You

Our service is free for customers. We are compensated by dealers when you purchase a vehicle from them. This commission is paid by the dealer and does not affect the price you pay.

4. Estimated Savings and Pricing

Savings estimates displayed on our website (such as "Save $1,000-$3,000" or "Typically save...") are general market estimates only, based on:

Historical data from similar transactions
General market observations
Comparison between typical retail walk-in pricing and competitive quotes

These are NOT guarantees of your specific outcome.

Actual results will vary based on:

The specific vehicle, variant, and optional features
Current market conditions and dealer inventory levels
Geographic location and regional pricing variations
Timing and seasonal factors
Individual dealer pricing strategies
Your negotiation and purchasing approach
Trade-in value (if applicable)
Finance arrangements (if applicable)

Some customers may achieve:

Greater savings than estimated
Lower savings than estimated
No savings compared to retail walk-in pricing

We make no warranty, representation, or guarantee regarding the amount of savings (if any) you will achieve through our service.

5. No Guarantee of Best Price

We do not guarantee:

That our quotes represent the lowest prices available in New Zealand
That you cannot find better pricing by contacting dealers directly or through other channels
That our dealer network includes all possible dealers for your vehicle
That dealer quotes provided are the best available from those specific dealers
That competing quotes will result in lower pricing than purchasing directly from a single dealer

Our service provides competing quotes from dealers in our network for comparison purposes only. Other dealers, promotional offers, manufacturer incentives, or direct negotiations may result in different (potentially better or worse) pricing.

Market conditions, dealer inventory, timing, and individual circumstances all affect pricing. What we provide is a convenient way to compare multiple quotes without visiting dealerships, not a guarantee of the absolute best price available in the market.

6. Finance Indication

If you indicate you need help with finance:

We may share your details with finance partners to facilitate finance quotes
We are NOT financial advisers and provide no financial advice
Any finance arrangements are between you and the finance provider
You should seek independent financial advice before committing to any finance

We do not arrange, recommend, or advise on finance products.

7. No Obligations

By requesting quotes through our service:

You are under no obligation to purchase any vehicle
You are free to negotiate directly with dealers or walk away at any time
You can request dealers stop contacting you at any time

8. Dealer Relationships and Quote Accuracy

We maintain relationships with dealers who pay us a referral fee when you purchase from them. However:

We aim to provide you with multiple competing quotes
Dealers set their own prices independently
We do not control or guarantee dealer pricing, behavior, or business practices
Any disputes with dealers must be resolved directly with them

Dealer quotes provided through our service:

Are indicative only and subject to change without notice
May be withdrawn or modified by dealers at any time
Are subject to vehicle availability at time of purchase
May have additional terms, conditions, fees, or charges not reflected in initial quote
Must be confirmed directly with the dealer before purchase

We are not responsible for:

Dealers changing quoted prices after we provide them to you
Vehicles being unavailable despite quotes provided
Differences between quoted and final pricing
Additional fees, charges, delivery costs, or conditions imposed by dealers
Dealer failure to honor quoted prices or terms
Dealer response times or failure to respond

You must confirm all pricing, terms, availability, vehicle condition, and conditions directly with your chosen dealer before committing to purchase.

9. Finance Partner Relationships

We may receive a commission from finance partners if you arrange finance through them. However:

We are NOT financial advisers
Finance providers set their own rates and terms
We do not control or guarantee finance terms, rates, or approval
You should compare finance options independently
Any disputes with finance providers must be resolved directly with them

10. Your Responsibility

You are responsible for:

Providing accurate information in your quote request
Conducting your own due diligence on any vehicle purchase
Reviewing and understanding all dealer terms and conditions
Inspecting vehicles and reviewing all documentation before purchase
Making your own informed purchasing decisions
All aspects of your vehicle purchase transaction with the dealer
Confirming all pricing, terms, and conditions directly with dealers

11. Limitation of Liability

To the fullest extent permitted by law:

We provide our service "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We are not liable for:

Any dealer actions, conduct, representations, pricing, or vehicle condition
Inaccurate, incomplete, outdated, or withdrawn dealer quotes
Dealer failure to honor quoted prices, terms, or availability
Delays in obtaining or providing quotes from dealers
Vehicle unavailability despite quotes provided
Your inability to secure financing or acceptable finance terms
Differences between expected and actual savings
Any economic losses, consequential damages, indirect losses, or loss of profits arising from your use of our service
Any losses arising from reliance on information, quotes, or estimates provided through our service
Technical issues, website downtime, or data transmission errors

Maximum liability cap: Our total aggregate liability to you for any and all claims related to our service, regardless of the form of action (whether in contract, tort, negligence, strict liability or otherwise), shall not exceed NZ$100 (one hundred New Zealand dollars).

Third-party dealers and finance providers: We are not responsible for and expressly disclaim all liability for the actions, omissions, representations, conduct, pricing, or services of any dealer, finance provider, or other third party in our network. All transactions, agreements, and disputes are between you and those third parties directly. We are not a party to any transaction between you and a dealer or finance provider.

Consumer Guarantees Act: Nothing in these terms excludes or limits liability that cannot be excluded or limited under New Zealand law, including the Consumer Guarantees Act 1993 where applicable. However, to the extent our service is acquired for business purposes, you agree that the Consumer Guarantees Act 1993 does not apply.

12. Privacy

Your use of our service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

13. Changes to Terms

We may update these Terms & Conditions from time to time. The "Last updated" date at the top of this page indicates when these terms were last revised. Continued use of our service after changes constitutes acceptance of the updated terms. We encourage you to review these terms periodically.

14. Governing Law

These terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of or relating to these terms or our service will be subject to the exclusive jurisdiction of the New Zealand courts.

15. Severability

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
